A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks legal authority.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.

The situation stems from a mistaken deportation to El Salvador in March, which the government later admitted was an mistake. Following his return to the United States to answer human smuggling charges, he was detained in federal detention.

In her order, the judge pointed out that the government does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
